These Terms and Conditions govern your use of the Quantum Building Maintenance website.

This website is operated by QBM Projects PTY LTD, trading as Quantum Building Maintenance (“QBM”, “we”, “us” or “our”).

By accessing or using this website, you agree to these Terms and Conditions. If you do not agree with them, please stop using the website.

1. Website information only

The information on this website is provided for general information about Quantum Building Maintenance and the services we offer.

Website content does not constitute:

• A formal quotation or offer

• Building, engineering, architectural or legal advice

• A guarantee that a particular service, price or timeframe will be available

• A substitute for a site inspection, professional assessment or statutory approval

Every property and building project is different. Advice, pricing and proposed solutions may change after we inspect the property and assess the site conditions, access requirements, existing structures, plans and scope of work.

2. Quotes, estimates and building contracts

Submitting an enquiry or requesting a quote does not create a contract between you and Quantum Building Maintenance.

Any building, renovation, repair or maintenance work will be subject to a separate written quotation, scope of works, work order or building contract. That document may include project-specific terms relating to:

• The agreed scope of work

• Inclusions and exclusions

• Pricing and payment requirements

• Deposits and progress payments

• Variations

• Project timing

• Site access

• Client responsibilities

• Delays and extensions of time

• Defects and warranties

• Cancellation or termination

• Dispute resolution

Where Queensland law requires a particular form of building contract, notice, cooling-off period, insurance arrangement or consumer warning, the applicable statutory requirements will apply.

If there is an inconsistency between these website terms and a signed project contract, the signed project contract will govern the project to the extent of the inconsistency.

3. QBCC licensing and regulatory requirements

Quantum Building Maintenance carries out, coordinates or arranges building and maintenance services subject to the licensing requirements that apply to the relevant type and value of work.

Certain work must only be performed or supervised by appropriately licensed contractors. We may engage qualified subcontractors, tradespeople, consultants, engineers or certifiers where required.

A contractor’s licence details can be checked through the official QBCC Licensee Register.

References to QBCC licensing, insurance or compliance on this website do not mean that every service is covered by the Queensland Home Warranty Scheme. Eligibility depends on the nature, value and circumstances of the work and the applicable legislation.

4. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, statutory warranty, right or remedy that cannot lawfully be excluded under:

• The Australian Consumer Law

• The Queensland Building and Construction Commission Act 1991

• The Queensland Building and Construction Commission Regulation 2018

• The Building Industry Fairness (Security of Payment) Act 2017

• The Domestic Building Contracts Act 2000

• Other applicable Commonwealth, state or local legislation

Where goods or services are supplied to a consumer, statutory guarantees may apply, including guarantees that services will be provided with due care and skill, be reasonably fit for an agreed purpose and be supplied within a reasonable time where no timeframe has been agreed.

These website terms must be read subject to those rights.

5. Pricing and promotions

Any prices displayed on this website are general indications only unless expressly stated otherwise.

Final pricing may depend on factors including:

• The condition and location of the property

• Site access and working conditions

• The final scope and specifications

• Labour and material requirements

• Structural, electrical or plumbing considerations

• Asbestos, hazardous materials or concealed conditions

• Engineering, certification or approval requirements

• Supplier availability

• Other conditions discovered during an inspection or after work begins

Unless clearly stated otherwise, prices are in Australian dollars. Whether GST is included will be stated in the applicable quotation or contract.

Promotional offers may be subject to separate eligibility requirements, availability, expiry dates and written terms.

6. Estimates and project timeframes

Any timeframe shown on this website or discussed before a formal assessment is an estimate only.

Project timing may be affected by weather, site access, product availability, subcontractor availability, variations, approvals, inspections, concealed conditions, safety issues and events outside our reasonable control.

Confirmed timeframes and procedures for extensions of time will be set out in the applicable quotation or contract.

7. Plans, approvals and certification

Depending on the proposed work, building approval, planning approval, engineering, certification, body corporate approval, landlord consent or another third-party approval may be required.

Unless expressly included in our written scope:

• You are responsible for confirming that you have authority to approve work at the property

• You must disclose relevant easements, body corporate rules, property restrictions and known defects

• Approval, certification, engineering and professional consultant costs may be additional

• Work will not necessarily commence until required approvals have been obtained

We do not guarantee that a council, certifier, engineer, body corporate, insurer or regulator will approve a proposed design or scope.

8. Existing and concealed site conditions

Website information and initial discussions cannot account for every site condition.

Conditions that may only become apparent during inspection or construction include water damage, structural deterioration, termite damage, asbestos, mould, non-compliant existing work, defective services, inadequate waterproofing or concealed electrical and plumbing issues.

The process for addressing unforeseen conditions, additional work and price variations will be contained in the applicable project documentation.

9. Images and project examples

Photographs, plans, illustrations, renders and completed-project examples on this website are provided for general inspiration and demonstration purposes.

They may:

• Show work performed under different site conditions or budgets

• Include products or finishes that are no longer available

• Contain digitally prepared concepts or stock imagery

• Differ from the final result achievable at your property

Colours and finishes may also appear differently depending on lighting, photography and screen settings.

No particular result is guaranteed unless it is expressly included in a signed project contract.
